Agreement
On acceptance of deposit or rental payment in respect of a holiday letting a contract exists under English law with the following terms and conditions. The agreement is between the client (You) and Mr & Mrs R F Pennell or the owner identified in your confirmation letter (We or Us). Payment indicates that You are aware of the property description.
The agreement is for a stated number of people including infants of any age as permitted by the owners and does not allow additional persons overnight without prior agreement by Us. If this is breached the lease may terminate immediately and without refund. No pets of any kind are allowed.
The Rental Period, unless otherwise stated, is from 4:00 p.m. on the start date until 10:00 a.m. on the end date.
Payment
A Deposit of 25% is required to confirm the reservation. Full payment is due 42 days (six weeks) prior to the arrival date. This includes the remainder of the agreed rental for the total stay and a Security payment as described below. If We have not received full payment by 21 days (three weeks) prior to the arrival date, the booking may be deemed to be cancelled and You will be liable for cancellation charges.
Security Payment
A security is required for each property booked. The amount varies - for our own apartments it is £100. We normally return the Security within one month after occupation less any exceptional costs including losses or damage resulting from the occupation. (Typical exceptional charges include: £20 for a set of lost keys, at least £20 if additional cleaning is required, £10 per hour or part hour for late departures.)
Cancellation
This may be by non-payment as above or by notifying Us in writing, by email, or by telephone. Change of property or date may be treated as cancellation and re-booking.
Cancellation Charges
In the event of cancellation We have full rights to retain the deposit and in addition you must pay the balance of rental (excluding per person service charges). Provided that the property can be re-let We will refund the rental minus the booking deposit (or our losses if they exceed the deposit).
Your Responsibilities
You are Responsible to take reasonable care of the property including locking doors and closing windows and security shutters whenever you leave it. You must be considerate regarding other residents, parking, and access for snow ploughs.
You must leave the property in the same state of repair and cleanliness you found it in. This includes washing up and replacing utensils, cleaning floors and surfaces including kitchen bathroom and toilet, disposing of rubbish; and removing bed linen as instructed.
Liabilities
You indemnify Us and hold Us harmless for all charges arising from services we contract directly for Your benefit including rental of French owned properties.
You may be charged for any housework required resulting from your occupation. You will be held responsible for uninsured losses or damages caused.
Your liability for loss or damage is not limited to the amount of the Security payment. You are advised to have holiday insurance including cancellation cover and third party liability.
If booked accommodation becomes unavailable due to events outside Our reasonable control, Our liability to You shall be limited to the total payments received. However we will make efforts to secure suitable alternative accommodation and may otherwise compensate you at our discretion.
